Small Cases Resolved by 20.080 demands

Good news for small cases. Under ORS 20.080 a claim can be made for damages for personal injury up to $7,500. The insurance company must respond within 30 days. If the insurance company does not pay the full amount and a lawsuit is filed, the insurance company will be responsible for attorneys fees and costs if the jury awards more that the amount offered during the 30 days.

This statute is very helpful to resolve small cases. There are proper steps that must be taken to satisfy the requirements of the statute. Please consult a lawyer if you have a case that might be resolved through a 20.080. The good news is that the limit is going up to $10,000 on January 1, 2012. This will made even more cases eligible for the benefits of this law.
